TERMS AND CONDITIONS

These Terms of Use ("Terms") govern your access to and use of the Land Specialist Academy website located at LandSpecialistAcademy.com (the "Site") and all courses, digital products, certification programs, community access, tools, and content provided by Land Specialist Academy, owned and operated by Don Leske, Managing Broker, Washington State ("Land Specialist Academy," "we," "us," or "our"). By accessing the Site or purchasing any product or service, you agree to be bound by these Terms in full.

Eligibility

You must be at least 18 years of age to use this Site or purchase any product. By using the Site, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement. Our products are intended for real estate professionals, brokers, builders, developers, and adult members of the public interested in land development education. We do not knowingly sell products to minors.

Operating Entity and Credential Disclosure

Products and Services

Land Specialist Academy offers the following categories of products and services:

• Digital downloadable products (eBooks, checklists, calculators, templates)
• Online courses delivered via the Kajabi platform
• The LOT LOGIC™ system: a three-phase land evaluation methodology delivered as educational content
• The CLS™ (Certified Land Specialist) professional designation, awarded upon completion of Level 2 certification requirements
• The LSC (Land Specialist Community), a private professional community accessible to CLS™ certified members at Level 2 and above
• Coaching and group participation programs at Level 3 and Level 4
• The LOT LOGIC™ Instructor Program, which includes a market licensing arrangement for Level 4 participants

All trademarks, including LOT LOGIC™, CLS™, FEASIBILITY FIRST™, BULLETPROOF YOUR BUILD™, LAND RUSH™, and LAND SPECIALIST ACADEMY™, are the intellectual property of Don Leske and Land Specialist Academy. All rights reserved. 

Account Registration

Purchasing a product or enrolling in a program requires creation of a Kajabi account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Sharing login credentials with any third party is strictly prohibited and constitutes a material violation of these Terms. Violations will result in immediate account termination without refund.

Payments

All prices are listed in United States Dollars (USD). Payment is processed at the time of purchase through Kajabi's payment infrastructure (powered by Stripe). Land Specialist Academy does not store credit card numbers or sensitive payment data. By completing a purchase, you authorize Land Specialist Academy to charge the applicable amount to your payment method.

Payment Plans

Certain products are available on installment payment plans. By enrolling in a payment plan, you agree to pay each installment on its scheduled due date. Failure to complete scheduled payments will result in suspension of access to the applicable course or program until your account is current. Incomplete payment plans do not entitle you to a refund of amounts already paid.

Annual Renewals

The CLS™ designation includes an annual renewal fee of $195 USD. This renewal is processed automatically on the anniversary of your original enrollment date. You will receive written notice no fewer than 30 days prior to the renewal charge. You may cancel automatic renewal at any time before the renewal date by contacting us at the email address listed in Section 15. Annual renewal fees are non-refundable once billed. Failure to renew results in lapse of active CLS™ designation status and suspension of LSC community access until renewal is completed.

Refund and Cancellation Policy

Action Kit — $47

No refunds. This product is a digital download delivered instantly upon purchase. All sales are final.

LOT LOGIC™ Core — $997

Refund requests may be submitted within 7 calendar days of purchase, provided that fewer than 20% of the course content has been accessed or any downloadable files have not been opened. To request a refund, email us with your order number and reason for the request. Approved refunds will be processed within 10 business days. No refunds will be issued after 7 days or after the 20% content threshold is exceeded, whichever occurs first.

LOT LOGIC™ CLS™ Certification — $4,997

Refund requests may be submitted within 14 calendar days of purchase, provided that the certification quiz has not been accessed and fewer than 20% of course modules have been viewed. No refunds will be issued after 14 days or upon any access to the certification quiz. If you are enrolled in a payment plan, cancellation of a payment plan does not entitle you to a refund of amounts already paid, and you remain responsible for installments already charged.

LOT LOGIC™ Masterclass — $9,997

No refunds. This program includes scheduled 1:1 coaching and group participation components. Due to the time-intensive nature of these engagements, all sales are final at the time of purchase.

Instructor Training Program — $20,000

No refunds. This program includes a market licensing arrangement, dedicated instructor onboarding, and personalized coaching time that begins immediately upon enrollment. All sales are final. Specific terms of the market license are governed by a separate License Agreement executed at enrollment, which supersedes these Terms on licensing matters.

eBooks and Digital Downloads (Feasibility First™, Bulletproof Your Build™)

No refunds. All digital product sales are final upon delivery.

LSC Community Access

Community access is granted as part of qualifying product enrollment (Level 2 and above). There is no standalone charge for community access, and therefore no separate refund is applicable. Loss of community access due to violation of Community Guidelines does not entitle a member to any refund of their original product purchase.

Intellectual Property

All content provided by Land Specialist Academy — including but not limited to course videos, written materials, checklists, calculators, templates, the LOT LOGIC™ methodology and all related frameworks, feasibility tools, the CLS™ designation program, and all brand assets — is the exclusive intellectual property of Don Leske and Land Specialist Academy. All rights are reserved.

License Grant: Upon purchase, you are granted a limited, personal, non-transferable, non-exclusive license to use purchased materials for your own professional practice. This license does not include the right to: 

• Reproduce, copy, or distribute any course content or downloadable materials
• Share login credentials or grant access to any third party
• Record, screenshot, or screen-capture any video content
• Resell, sublicense, or commercially exploit any materials
• Create derivative works based on the LOT LOGIC™ system or any course materials without written authorization

Violations of these restrictions constitute copyright infringement and breach of these Terms, and will result in immediate account termination without refund, in addition to any available legal remedies. 

CLS™ Certification — Terms of Designation

The Certified Land Specialist (CLS™) designation is awarded by Land Specialist Academy upon verified completion of Level 2 requirements, including course completion and passing the certification assessment. The following terms govern use of the designation:

• The CLS™ designation remains active only while annual renewal fees are current.
• You may represent yourself as a CLS™ Certified Land Specialist in professional materials, listings, and marketing, provided your designation is current and active.
• You may not represent the CLS™ designation as a government-issued license, a legal credential, or a guarantee of any specific outcome.
• Land Specialist Academy reserves the right to revoke the CLS™ designation for: (a) violation of these Terms; (b) violation of Community Guidelines; (c) misrepresentation of certification status; (d) conduct determined to be materially harmful to the reputation of the designation or the profession.
• Revocation of the CLS™ designation results in immediate loss of LSC community access and termination of any active annual renewal. No refund will be issued upon revocation.
• Revocation is at the sole and absolute discretion of Land Specialist Academy. By enrolling, you waive any claim for defamation or lost business income resulting from the loss of your designation status.

LSC Community

Access to the Land Specialist Community (LSC) is restricted to members holding an active CLS™ designation at Level 2 or above. By accessing the LSC, you agree to be bound by the Community Guidelines published at LandSpecialistAcademy.com/community-guidelines (incorporated herein by reference). Violation of Community Guidelines may result in permanent removal from the LSC without refund.

User-Generated Content

By posting content within the LSC community or any interactive feature of the Site ("User Content"), you grant Land Specialist Academy a non-exclusive, royalty-free, worldwide license to display, share, and use that content within the platform for educational and community purposes. You retain ownership of your User Content. You represent and warrant that: (a) you own or have the rights to post your User Content; (b) your User Content does not violate any third-party rights; and (c) your User Content complies with these Terms and the Community Guidelines.

Disclaimer of Warranties

The site and all products, services, and content are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Land Specialist Academy does not guarantee that any course, tool, checklist, or certification will result in a building permit, profitable transaction, or specific financial outcome.

Limitation of Liability

To the maximum extent permitted by applicable law, land specialist academy's total liability to you for any claim arising out of or related to these terms or your use of the site or any product shall not exceed the amount you paid to land specialist academy in the 90 days preceding the claim. In no event shall land specialist academy be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost deals, or loss of data, even if advised of the possibility of such damages.

Dispute Resolution and Arbitration

Informal Resolution

Before initiating any formal dispute, you agree to contact Land Specialist Academy in writing at the email address in Section 15 and provide a written description of the dispute and the relief sought. Both parties agree to make a good-faith effort to resolve the dispute informally within 30 days of that written notice.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site or any product shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be conducted in Washington State. The arbitrator's decision shall be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.

No Class Actions

You agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate as a plaintiff or class member in any class action proceeding.

Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws provisions.

Modifications to Terms or Products

Land Specialist Academy reserves the right to update these Terms, modify product pricing, or adjust course content at any time. For enrolled members, material changes to Terms will be communicated by email no fewer than 14 days before taking effect. Your continued use of the Site or products after notice constitutes acceptance of the updated Terms. We reserve the right to discontinue any product or feature with reasonable notice.

Termination

Land Specialist Academy may terminate or suspend your account and access to any product at any time, with or without notice, for violation of these Terms or for any conduct that we determine, in our sole discretion, is harmful to other members, the community, or the Land Specialist Academy brand. Termination for cause does not entitle you to a refund.
